Membership Agreement
- Parties
- a) The sole proprietorship named Adil Çelik, operating the website https://www.EngineerENG.com/ located in Ankara (hereinafter will be referred to as “EngineerENG.com”).
- b) The internet user who becomes a member of the website https://www.EngineerENG.com/ (“Member”).
- Subject of the Agreement
The subject of this Agreement is to determine the conditions under which the member can benefit from the internet site owned by EngineerENG.com, accessible at https://www.EngineerENG.com/.
- Rights and Obligations of the Parties
3.1. The Member declares and undertakes that the personal and other information provided while joining the website https://www.EngineerENG.com/ is accurate under the law and that they will indemnify any damages suffered by EngineerENG.com due to the falsity of this information immediately and in full.
3.2. The Member cannot share the password given by EngineerENG.com with other people or organizations; the right to use the said password belongs to the member themselves. Therefore, EngineerENG.com reserves all rights to compensation and other claims against all allegations and demands that may be put forward by third parties or authorized authorities due to such unauthorized use.
3.3. The Member accepts and undertakes from the outset to comply with the legal legislation while using the website https://www.EngineerENG.com/ and not to violate it. Otherwise, all legal and penal obligations that may arise will bind the member exclusively.
3.4. The Member cannot use the https://www.EngineerENG.com/ website in any way that disrupts public order, against general morality, harasses or annoys others, for an illegal purpose, and infringes on the intellectual and copyright rights of others. Additionally, the member cannot engage in activities (spam, virus, Trojan horse, etc.) that prevent or complicate the use of services by others. Communication channels outside the site cannot be used, and payment transactions cannot be conducted outside the site.
3.5. Ideas and opinions stated, written, used by members on the https://www.EngineerENG.com/ website are entirely the personal views of the members and bind the opinion holder. These opinions and thoughts have no relation or connection with EngineerENG.com. EngineerENG.com has no responsibility for any damages that may be incurred by third parties due to the ideas and opinions stated by the member and the damages the member may incur due to the ideas and opinions stated by third parties.
3.6. EngineerENG.com will not be responsible for unauthorized reading of member data or damage to member software and data. The Member has preemptively accepted not to demand compensation from Adil Çelik for any damages that may be suffered due to the use of the https://www.EngineerENG.com/ website.
3.7. The Member agrees not to access or use the software and data of other internet users without authorization. Otherwise, all legal and criminal responsibilities arising from this will belong entirely to the member.
3.8. A member violating one or several of the articles listed in this membership agreement will be personally responsible criminally and legally for such violation and will keep EngineerENG.com free from the legal and penal consequences of these violations. Moreover, in the case of legal action due to such violations, EngineerENG.com reserves the right to claim compensation from the member for non-compliance with the membership agreement.
3.9. EngineerENG.com has the right to delete the membership of the member and to delete files, documents, and information belonging to the customer unilaterally when necessary. The member accepts this disposition in advance. In this case, EngineerENG.com has no responsibility.
3.10. The software and design of the https://www.EngineerENG.com/ website are the property of Adil Çelik, and copyright and/or other intellectual property rights related to them are protected under the relevant laws. These cannot be used, acquired, or modified without permission by the member. The names and products of other companies mentioned on this website are the trademarks of their owners and are also protected under intellectual property rights.
3.11. In the course of improving and developing the https://www.EngineerENG.com/ website and/or within the framework of legal regulations, some information such as the name of the Internet service provider used to access the site and the Internet Protocol (IP) address, the date and time of access to the site, the pages accessed while on the site, and the Internet address of the website that directly connects to the site can be collected.
3.12. EngineerENG.com may disclose the personal information of the member when legally required or when (a) acting in accordance with legal requirements or complying with legal processes served on EngineerENG.com; (b) protecting and defending the rights and property of Adil Çelik and the https://www.EngineerENG.com/ website family is deemed necessary in good faith.
3.13. Necessary measures have been taken within existing means to ensure the https://www.EngineerENG.com/ website is free from viruses and similar software. However, the user is required to supply their virus protection system and ensure the necessary protection for ultimate security. In this context, by entering the https://www.EngineerENG.com/ website, the member accepts that they are responsible for all errors and their direct or indirect consequences that may occur in their software and operating systems.
3.14. EngineerENG.com reserves the right to change the content of the site at any time, to modify or terminate any service provided to users, or to delete the information and data registered on the https://www.EngineerENG.com/ website of users.
3.15. EngineerENG.com can change, update, or cancel the conditions of the membership agreement at any time without any notice and/or warning in any form. Each provision that is changed, updated, or repealed will be effective for all members at the time of publication.
3.16. The parties accept and declare that all computer records belonging to Adil Çelik shall be considered as the sole and true exclusive evidence in accordance with Article 287 of HUMK (Code of Civil Procedure) and that these records constitute an evidence agreement.
3.17. EngineerENG.com is authorized to send informational emails to the electronic mail addresses and informational SMS to the mobile phones of its members recorded with it, pursuant to this membership agreement. By approving this membership agreement, the member is deemed to have accepted the sending of informational mails to their electronic mail address and informational SMS to their mobile phone.
3.18. The member undertakes that the questions they ask on this site do not affect the rights of third parties, such as homework, exam questions, etc., and accepts responsibility for the legal situations that may arise.
- Termination of the Agreement
This agreement will remain in effect until the member cancels their membership or EngineerENG.com cancels the membership. EngineerENG.com can unilaterally terminate the agreement by canceling the member’s membership if the member violates any provision of the membership agreement.
- Dispute Resolution
The Courts and Execution Offices of Ankara are authorized for disputes related to this agreement.
- Effectiveness
The member’s act of registration implies that they have read all the articles in the membership agreement and accepted the terms stated in the membership agreement. This Agreement is mutually agreed upon and comes into effect at the moment of the member’s registration.
